Nectar Trial Terms and Conditions
1.1 We are Severn Trent Water Limited ("STW"), a company registered in England and Wales whose registered number is 02366686 and registered address is at Severn Trent Centre, 2 St John's Street, Coventry, CV1 2LZ.
1.2 We have partnered with Nectar 360 Limited ("Nectar"), the company behind Sainsbury's Nectar loyalty programme, to trial a scheme aimed at encouraging STW customers to think more consciously about their water consumption and reduce the amount of water they use. The trial scheme will involve participates being given a weekly target for reducing their water consumption and those who are successful in achieving their target will be rewarded with Nectar points (the "Trial").
1.3 This document sets out the terms and conditions (the "Conditions") you must agree to in order to participate in the Trial. Please read these Conditions in full and ensure you agree with their terms before you click to accept them. By participating in the Trial you agree to be bound by these Conditions.
1.4 If you have any queries about anything contained in these Conditions, you can contact us by either:
- We wish to draw your attention to the provisions listed below, which are contained in these Conditions and are particularly important to our relationship with you. However, the provisions set out below are not an exhaustive list and it is extremely important that you read and understand these Conditions in full.
- Section 9 (Our liability to you) sets out our responsibility to you if we fail to do what we are agreeing to do in these Conditions. We do not limit in any way our liability to you where it would be unlawful to do so.
- Section 5 (How does the Trial work?) sets out how the Trial will operate. Please ensure you understand this and contact us if anything is unclear.
- The Trial is free to join and is open to STW customers who are invited by us to participate and who meet all of the eligibility criteria set out in this section 3. You will not be able to take part in the Trial unless you have been invited by us to do so.
- The Trial start date is 18 November 2024 (“Trial Start Date”) and the Trial is expected to run for up to 18 months. Not all participants will be invited to join the Trial from the start and we will send out invitations for further participants to join during the course of the Trial.
- We may invite you to participate in the Trial if you:
- are a STW customer and have an active billing account;
- live in one of the following locations: Coventry, Warwickshire, Birmingham, Leicestershire or Shropshire (the “Trial Locations”); and
- have a smart meter which provides daily meter readings to STW.
- You will also be required to have a Nectar account before you sign up to the Trial (the “Eligibility Criteria”). Not every STW customer that meets the Eligibility Criteria will receive an invitation from us to participate in the Trial.
- We may from time to time change certain conditions of the Trial such as the length of the Trial itself, the way we calculate targets and the number of Nectar points we offer. We will notify you of any changes in writing.
- You can end your participation in the Trial at any point. We reserve to right to end the Trial at any time and will give you notice in writing when we decide to do so.
- If you become a participant in the Trial during the first 3 months from the Trial Start Date and you move house at any time during that 3 months period, you may be excluded from participating in the Trial going forward. Otherwise, if you are a participant in the Trial and you move house during the Trial at any time after 3 months from the Trial Start Date, you will be able to continue participating in the Trial provided you continue to meet all of the Eligibility Criteria (including that your new house is situated within one of the Trial Locations).
- If you are a participant in the Trial, you move house during the Trial and, as a result of moving house, you no longer meet the Eligibility Criteria (including that your new house is not situated within one of the Trail Locations, or does not have a smart meter), we may end your participation in the Trial immediately on notice.
- You can only sign up to the Trial if you receive an invite from us to do so. If you do receive an invite from us to sign up to the Trial, that invite is personal to you and you must not transfer the invite to anyone else.
- We will send invitations out via email. If you receive an invitation from us, you must complete the following steps to successfully sign up to the Trial:
- You must click the link contained within our email, which will prompt you to sign in to your STW account. Once you sign in, you will be taken to My Smart Tracker.
- In My Smart Tracker, there will be a new Nectar tab – you must click on this tab, which will take you to the Trial sign up page.
- You will then be asked to link your Nectar account with your STW account by entering the last 11 digits of your Nectar account number. If you do not have a Nectar account, you will be able to follow a link from the Nectar tab in My Smart Tracker to open a Nectar account. You will not be able to participate in the Trial (and be awarded Nectar points) if you do not link your Nectar card number to your STW account.
- You will then be required to check a box confirming your acceptance of these Terms.
- By signing up to the Trial, you confirm that you meet all of the Eligibility Criteria. We reserve the right to request proof from you that you are eligible to participate in the Trial.
- We will provide you with a weekly water reduction target (a "Target") by Sunday evening of each week and this will be your Target for the following Monday to Sunday. Please note that Targets are calculated based on your household water consumption and are not individual targets. Your Targets will be accessible from your STW account via the Nectar Dashboard in My Smart Tracker. If you achieve your Target for the week, you will be awarded Nectar points.
- You can also collect Nectar points for other activities, such as logging into your STW account each week. Further information on how Nectar points can be collected is set out in section 6 (How are Nectar points calculated) below.
- We will provide you with your first week’s Target once you have successfully signed-up to the Trial. This will be calculated by taking your average water consumption in litres during the 4 weeks prior to you joining the Trial and reducing it by 3%. That number is then rounded up to the nearest whole number to give your Target for the week.
- For example:
- If your household consumed 300 litres of water in week 1, 330 litres in week 2, 366 litres in week 3 and 348 litres in week 4, your household’s total water consumption over that 4 week period would be 1,344 litres, and your household’s average water consumption over that 4 week period would be 336 litres. A 3% reduction of 336 litres is 325.92 litres. This means your Target for the first week would be 326 litres.
- If, at the end of the week, the amount of water you have consumed that week is the same as or less than your Target, you will be awarded Nectar points. If you have consumed more water than your Target, you will not receive any Nectar points for that week.
- You will receive a new Target each week which will be calculated in the same way, taking the average of your water consumption in the 4 weeks prior to the week being calculated and applying a 3% reduction. This means that your Target is likely to change over the course of the Trial.
- If at the end of any week, your water consumption for that week is less than 5 litres, we may assume that you have been absent from your property during that week and as a result, we will:
- be entitled to not award you any nectar points for achieving your Target for that week; and
- remove your water consumption figure for that week from the calculation of your next week’s Target and calculate that Target based on the remaining weeks only.
- This will not affect the Nectar tier status you have achieved up to that week in accordance with clause 6.1.3 and you will retain your current tier status at that time.
- If at the end of any week, we have not received any meter readings from you to calculate your water consumption from that week, and the lack of meter readings is due to a fault of STW, we will:
- assume you have achieved your Target for that week if you have achieved your Target for the previous week;
- award your Nectar points in accordance with the tier you achieved in the previous week; and
- not include your water consumption figure for that week in the calculation of your next week’s Target and will calculate that Target based on the remaining weeks only.
- You can collect more Nectar points the more consecutive weeks you manage to meet your Target - further information is set out in section 6 below.
- During the Trial, you will be able to collect Nectar points for the following activities:
1.1 Signing up and joining the Trial – you will collect 100 Nectar points when you link your Nectar account to your STW account on My Smart Tracker.
1.2 Ongoing activity on your account – you will collect 10 Nectar points for each week that you access the Nectar Dashboard in My Smart Tracker via your STW account at least once (please note that you will only receive 10 Nectar points per week, irrespective of how many times you log into your account in that week).
1.3 Achieving your target - you will collect Nectar points for each week that you achieve your target. The number of points avaiblable for achieving your target increases in the event you acheive your target for consecutive weeks, as follows -

The maximum Nectar points you can achieve in a week is 300 for achieving your Target, plus 10 for accessing the Nectar Dashboard on My Smart Tracker. If you do not achieve your Target in a particular week, you will lose any tier status you have previously achieved. The number of points you receive the next time you achieve your Target will start again from week one – this will not affect any Nectar points that have already been transferred to your Nectar account.
1.4 Switching billing – You may earn a one off award of 1000 Nectar points if you switch from unmeasured to measured billing during the Trial. Please note that if you switch from unmeasured to measured billing during the Trial, you cannot switch back to unmeasured billing until your participation in the Trial ends.
2. We may from time to time offer some participants additional Nectar points in respect of other activities. We will notify those participants if such an offer becomes available to them.
3. Any Nectar points you achieve will be added to your Nectar account on a weekly basis.
- By signing up to participate in the Trial, you agree to:
- link your Nectar card account to your STW account and keep both accounts active for the duration of your participation in the Trial. This allows you to access all the information you need to participate in the Trial and allows us to allocate your Nectar points. You acknowledge that we will not be liable to you if you are unable to participate in the Trial and/or we are unable to transfer you Nectar points because you do not link your accounts, you insert the incorrect Nectar card number or you do not maintain active STW and Nectar accounts for the duration of the Trial; and
- permit STW and Nectar to share information about you relating to the Trial, as detailed in section 11 (How we may use your personal data).
- You understand and agree that once Nectar points have been allocated to your Nectar account, we have no further responsibilities in relation to those points and their use, and such use shall be in accordance with the relevant terms and conditions applicable to your Nectar account.
- It is important that you understand what we are responsible for under the Trial and we hope the information below is helpful to you. Please contact us if anything is unclear.
- We are responsible for:
- providing you with access to all relevant information about the Trial via your STW account on My Smart Tracker, which is provided in accordance with our website terms and conditions available here: https://www.stwater.co.uk/help-and-contact/legal/terms-and-conditions/terms-and-conditions/
- calculating your weekly Targets, weekly water consumption and Nectar points collected in accordance with these Conditions; and
- notifying Nectar on a weekly basis how many points (if any) should be allocated to your Nectar account.
- We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
- The Trial is for domestic and private use only. You agree not to participate in the Trial or use the Trial for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- We will not be liable for any failure to allocate Nectar points in accordance with these Conditions where such failure is caused by:
- your failure to link your Nectar card account with your STW account;
- you inserting the incorrect Nectar card number;
- any equipment failure, technical malfunction or any systems, satellite, network, server, computer hardware or software failure of any kind; or
- any act or omission of Nectar or any other third party.
- The Trial is expected to last up to 18 months but you will notified in advance of the specific end date of the Trial.
- You may change your mind at any point during the Trial and end your participation by unlinking your Nectar account and your STW account via the "Manage your ID" section within the Nectar Dashboard of My Smart Tracker.
- We may also end your participation in the Trial if:
- you do not meet the Eligibility Criteria; or
- we decide to end the Trial early.
- If we end your participation in the Trial, or the Trial finished on the end date, your STW account and Nectar account will be unlinked automatically by us.
- We will use the name and contact information we have in relation to your STW account to administer the Trial. We will also collect from you your Nectar card account number, which will be pseudonymised.
- We will process and store your data in line with the UK General Data Protection Regulation ("UK GDPR") under the lawful basis of ‘legitimate interests’ for your personal data. The information will be held by us for as long as is necessary and in accordance with UK GDPR.

- By accepting these Conditions, you agree that you understand that we will collect your data and share that data with Nectar for the purposes of managing and administering the Trial. We may make changes to these Conditions but these changes will be effective only if provided to you in writing.
Where a clause in these Terms requires us to notify you in writing, this include email and may also include post and text message.
Each of the clauses of these Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the rest of the clauses will remain in full force and effect.
Please note that these Conditions, their subject matter and their formation, are governed by English law and you can bring legal proceedings in respect of any disputes or claims in the English courts.
